Вот такая ситуация.
Человек живет и работает в стране более шести лет. В данный момент послал документы на последний, unlimited work permit, и получил пакет документов назад с письмом: Please note that you can not apply for an unlimited work permit as you have not been with the same business or company for a minimum of 60 months. И дальше натурально предлагается заплатить. Причина того, что в свое время человек поменял работу - банкротство предыдущего имплойера. То есть - совсем даже не по инициативе работника. Копалась на сайтах - не нашла такого закона... Может, это просто "развод" на деньги? Или на самом деле что-то такое официально имеет место? Если да - то кто-нибудь в курсе, где можно про это прочитать? Спасибо. |

An unlimited permit has a start date but no expiry date and entitles the employee to work for the specified employer for an unlimited period without the need to renew the permit yearly. In the event that the employee changes employment then a new work permit application must be made on their behalf. If an employee qualifies for an unlimited work permit then this should be specified when submitting the renewal application form. There is no charge for an unlimited work permit. |

Нужно отработать у одного работодателя все 5 лет, чтобы получить Unlimited work permit. Даже если получил его уже и решил сменить работу, то нужно опять все заново начинать, с платного на 2 года. У моего мужа пару месяцев назад была такая ситуация, его новый босс созванивался и узнавал все по этому поводу.

у меня unlimited work permit и сейчас сокращение на работе. я тоже под него попадаю. может кто-то знает, могу ли я претендовать на социал по сокращению? в стране 6 с половиной лет, но до сих пор жду

All applications will be considered on a case-by-case basis and on their merits. MRCI has met with the Work Permits section of the DETE and expressed concern that three months is not always sufficient time for a person to secure new employment. The Work Permits section has agreed to consider cases outside the three months in certain circumstances, on a case by case basis. For more information on what information should be provided with applications go to: http://www.entemp.ie/labour/workpermits/redundant.htm Limited Workplace Mobility allowed for Work Permit holders After several months of petitioning by the MRCI, the Department of Enterprise, Trade and Employment (DETE) has agreed to change their published regulations on the right of work permit holders to change employers, with certain limitations. The Department has confirmed that individuals with a work permit may change employer, after at least one year with the same employer, provided their new employment is within the economic sector they are already employed in. They can also seek new employment within another eligible sector. Importantly, in both cases there is no longer the need for the labour market test (FÁS requirements). Individuals still need to find a new employer, as the work permit will still be associated with a single, named employer. For example, a person who has been working in a restaurant for more than twelve months, who has found work in a different restaurant, may change employment provided they make a new application. The application fee, however, must still be paid. This is a very welcome development, and MRCI believes that it will go a long way towards giving people more freedom and choice about where they choose to work, and reduce the possibility for exploitation or workers becoming undocumented.
