Meanwhile, a Dublin student is to mount a legal challenge to college admission regulations which allow overseas students to 'buy' a place in medicine while their Irish counterparts can not.

The case is being taken by a Dublin student, Frank Prendergast from Blackrock who obtained 490 points in the Leaving Cert last year and who failed to get a place in medicine. However, poorer performing non-EU classmates succeeded by paying for their places.

Papers have been served on the Higher Education Authority which has set a quota for Irish and EU students, as well as on Education Minister, Mary Hanafin, and on the Attorney General.

Mr Prendergast offered to pay the same non-EU fees of ?25,000 to ?42,000 to the colleges, but was turned down. His forthcoming action is based on the claim that the authorities are acting unconstitutionally.

Former Tanaiste and Justice Minister Michael McDowell SC is one of the lawyers acting for Mr Prendergast and the solicitors are Aitken, Clay and Collins.

If the challenge is successful, it could not only have an impact on entry to medicine courses but could have a fundamental impact on the entire CAO application system.
