The trial of a Dublin man charged with the rape of a homeless teenager nearly two years ago has collapsed at the Central Criminal Court.

The man, who cannot be named for legal reasons, had pleaded not guilty to raping the then 19-year-old woman at a Dublin address on October 13, 2008.

Mr Justice Paul Carney directed the jury to return a verdict of not guilty as the evidence called by the prosecution supported an offence under the 1990 Criminal Law Rape Amendment Act, which deals with oral rape, anal rape and rape by the association of implements.

He said that accused man had been charged with an offence of what he deemed “old fashioned” rape covered by the 1981 Rape Act, where a man has unlawful sexual intercourse with a woman.

Mr Justice Carney thanked the jury for their careful consideration during the trial and exempted them from further service for a period of 10 years.
