А вот что я получила от Europe advice: "The rights of EU citizens and their family members (even if they are third country nationals) to travel and reside freely within the EU territory are foreseen in Directive 38/2004/EC. You may find this Directive here: http://eur-lex.europa.eu/LexUriServ/...77:0123:EN:PDF As you already know, in order for a third country citizen to come to an EU Member State, which is a part of the Schengen area, a Schengen visa is necessary. Please be informed that pursuant to Article 5(2) of the referred Directive, the receiving country should grant you as a family member of an EU citizen all possibilities to receive the necessary visa, which should be issued AS SOON AS POSSIBLE and FREE OF CHARGE. And this provision exists irrespective of whether or not you travel with your spouse. In any, even the most complicated case, the visa must be issued no later than in two weeks from the application day. Due to the fact that you will have the right of an entry because of your family ties with an EU citizen, the consular officers together with the application, may request from you only his or her passport and a document, proving your family ties with the EU citizen. You may find out more about your as the non-EU family member rights regarding the necessary documents at: http://ec.europa.eu/youreurope/citiz....htm?profile=0 So in your case we would propose you to explain once again your rights to the consular officers pusuant to the referred Directive (see the provided example in the above link). In case they continue to apply the requirements that you refer to in your enquiry, we would recommend you to contact SOLVIT. SOLVIT is an on-line problem solving network in which EU Member States work together to solve without legal proceedings problems caused by the misapplication of Internal Market law by public authorities. There is a SOLVIT centre in every European Union Member State (as well as in Norway, Iceland and Liechtenstein). Using SOLVIT is free of charge. You may find more information about SOLVIT as well as explanation of how to file a complaint online at the following website: http://ec.europa.eu/solvit/site/submission/index_en.htm We hope this information will prove to be useful to you. Sincerely, Your Europe Advice
