Man is barred from marrying wife's niece

A MAN who wants to marry his late wife's niece has been told it is illegal to go ahead with the ceremony.

The man, who lives in a rural part of Co Galway, has checked with - and received the all-clear from - the Catholic Church to proceed with his planned marriage to his wife's niece.

But he has now been informed that such a union is against the law. He would face criminal prosecution if he was to go ahead.

The man is prevented from marrying the woman under the law in respect of Consanguinity and Affinity Relationships. While consanguinity refers to a close relative by blood - and he has no blood relationship to the woman - it is the Affinity Relationships section of the law that prevents the marriage from proceeding.

Prohibitions based on affinity are said to reflect a historical, cultural and social tradition.

Deputy Callanan said: "I have written to Minister Harney and Minister McDowell to raise this issue, but I was dismayed when Minister McDowell referred me to Minister Harney and Minister Harney subsequently said it was a matter for Minister McDowell.

"This is an old outdated law which most of the churches updated a number of years ago. We need to update our laws to deal with this issue."

Ну как ни крути, можно будет поспорить, что этот закон будет изменен быстрее, чем принят любой иммиграционный акт.
