Renewal of Permission to Remain on the basis of valid employment permit A notice has been posted in the Garda National Immigration Bureau (GNIB) offices at Burgh Quay, Dublin regarding renewal of ‘Work Permit Permission’ for people who do not yet have their new work permit, in certain circumstances: The work permit permission (registration Stamp No. 1) will be renewed for one year without production of the new permit if the person: Has been registered with GNIB for 3 consecutive years Has proof that they or their employer has applied for a renewal Is not changing employer Has a current wage/salary slip and most recent P60 Has complied with the conditions of their permission to remain in Ireland Persons who have been less than 3 years on a ‘work permit permission’ (Stamp 1) and do not yet have their new permit can renew their permission to remain for 3 months. They can choose to renew without being issued a new Registration Certificate at no charge, or with a new certificate for ?100. If they opt for a new certificate it will be valid for only 3 months and they will be charged a further ?100 when their work permit is renewed. Employment Permits applications: new postage requirements & current processing times Details have been posted on the website of the Employment Permits Section of the Department of Enterprise, Trade and Employment on the following: New Postage Requirements: In order to streamline the processing of employment permit applications, please indicate on the front of the envelope the type of employment permit you are applying for e.g. Green Card, Employment Permit, Spousal/Dependant or ICT. Current Processing Times: Applications are processed strictly in date of receipt order. Details of processing times are updated regularly on the Department’s website. http://www.entemp.ie/labour/workpermits/ EU Treaty Rights applications still on hold Applications for residency made by non-EU nationals to the EU Treaty Rights Section of the Department of Justice, Equality and Law Reform on the basis of being married to EU nationals are still on hold. A legal case which questions Ireland’s transposition of the EU Regulations of May 2006 [European Communities (Free Movement of Persons) (No. 2) Regulations, 2006] has been appealed to the Supreme Court and until a decision has been made on this case applications are pending. MRCI suggests that people who receive refusal letters reply to the department stating that they are unhappy with this decision and will seek to have their applications reconsidered following the outcome of the afore-mentioned legal proceedings. It is also suggested that people make a complaint to the EU Commission office in Dublin: www.ec.europa.eu/ireland Guidelines on applications for Long Term Residency posted on INIS website. Applications for long term residence are processed by the General Immigration Division of the Department of Justice, Equality and Law Reform as part of an Administrative Scheme. Persons who have been legally resident in the State for over five years (ie: 60 months) on the basis of Employment Permit / Work Authorisation / Working Visa conditions may apply for a five-year residency extension and full access to the labour market without the need for a work permit. Periods of time where a person has not had legal residence cannot be counted towards an application for long term residence. Processing time for applications is currently 11 months. For further information on documents to be submitted and on dependant family members, contact: The Long Term Residence Section, General Immigration Division, 3rd Floor, INIS, 13-14 Burgh Quay, Dublin 2 / http://www.inis.gov.ie/en/INIS/Pages/WP07000029 |
